An office meeting was held at the Santa Barbara Regional Office for the purpose of conducting an informal conference. Present at the meeting were Licensing Program Manager Patty Gutierrez, Licensing Program Analyst Michael Avila, and Licensee Robin Weiss and Licensee's Husband Daniel Weiss.

The purpose of the informal conference was to discuss the recent cited deficiency of 8/1/18.

On 5/4/18, the Santa Barbara Regional Office received a complaint allegation Licensee handled child inappropriately.

A child, (C1), was observed with bruised marking on his ear. The child claimed his ear was pinched by staff while in the care of Licensee. A medical evaluation conducted by the child's own doctor and a forensic medical evaluation conducted by the Ventura Sheriff Department both concluded the bruise marks on C1 ears was consistent with his ears being pinched and rose to the level of child abuse. Statements obtained from other children, (C2 and C3) both independently state the child's (C1) ears were pinch by staff while in care at the facility when being placed on "time out". Two other children, who could not be qualified, also stated Licensee pinched the ears of children while in her care.

On 8/1/18, the allegation of Licensee handled child inappropriately was SUBSTANTIATED. Licensee was issued a type "A" citation for violating CCR, Title 22, Division 12 Regulations section Personal Rights - 102423(a)(4) states each child shall be free from corporal or unusual punishment.

The following was discussed and the licensee has agreed to the following from todays office conference;
  • Licensee must ensure children are free from corporal or unusual punishment.
  • Licensee must ensure each child receiving services from a family child care home shall be accorded dignity in his/her personal relationships with staff, residents and other persons.
  • Licensee must ensure children are provided safe, healthful and comfortable accommodations, furnishing and equipment.
  • Licensee attend a Family Child Care Home Orientation.

Licensee will submit a written plan of correction to Community Care Licensing by August 24, 2018, outlining a plan on how she will comply with the above items.

Licensee was provided information handout pamphlets from Children's Home Society of California addressing the following: Stress and How it affects a Child, Information in Working with Special Needs Children, Positive Communication with Children, Positive Discipline with a Child, and Building a Child's Confidence and Success.

Licensee must operate in Compliance Title 22, Division 12 Child Care Regulations at all times. Licensee was also informed she will be placed on a two year Compliance Plan.

Increased unannounced visits to the facility will be made for the next two years to monitor compliance.


Licensee was informed that any additional Type A deficiencies may result in a more immediate administrative action against the License.

Upon receipt, Licensee shall provide copies of this licensing report to parents/guardians of children in care and to parents/guardians of children newly enrolled at the facility during the next 12 months. The Acknowledgement of Receipt (LIC 9224) to parents shall be completed and signed by each parent/guardian with copies maintained in each child's file. Licensee was given a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports.
