Licensing Program Analyst (LPA) Iman Al-Absi conducted an unannounced Random Annual inspection with Licensee Barbara Hibbert. There were five children in care. Also present in the home was Licensee's minor son/helper. Facility is within ratio and capacity. Business hours are Monday - Friday from 6am to 6pm. LPA conducted a tour of the home and outdoor play area to ensure compliance with standards established in CCR, Title 22, Division 12, Chapter 3. Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include living room, family room, dining room, kitchen, one bath and side yard for outdoor activities. Off limits areas include four bedrooms, one bath, backyard and garage. Garage is made inaccessible through lock.

During the tour of the kitchen, a sharp knife was found accessible to children on the edge of sink in kitchen. In a top kitchen drawer, a large drill along with nails were found accessible. The drawer did not have a latch or lock. Per Licensee, she was using the drill and nails to install new latches but project was not completed. It is to be noted that the kitchen is an open area that is not barricaded and opens into the main play area were children were present.

During the tour of the side yard, LPA observed a lawn mower along with a car toy with a broken seat accessible to children in care. The gate that leads to backyard was found open. In the backyard is a jacuzzi that was found unlocked and accessible to children. The jacuzzi contained warm water at time of visit. Although the jacuzzi had a cover, the latches of the cover were all found unlocked at time of visit allowing the cover to be easily lifted. The lock portion of latches were pointed out to Licensee. Per Licensee, she did not know that they could be locked and she does not have they key. An immediate civil penalty of $500 was assessed. The backyard also contained an uncovered BBQ grill and gardening tools. Licensee barricaded the backyard area at time of visit by closing the gate that is in between the side and backyard. Since the gate cannot be locked, Licensee placed a large play home in front of the gate temporary barricading access.

(a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Licensee was unable to provide documentation of immunizations. This poses a potential Health & Safety risk of clients in care.

All other hazardous items were latched, locked and secured out of reach of children. There is currently no fire extinguisher or carbon monoxide detector in home. Per Licensee, an incident occurred this past Saturday where the dryer caught fire and Licensee had to use the fire extinguisher to contain fire. The dryer is located in the garage near the play area. Licensee states there were no children in care at time of incident. There were no structural damages but fire department did respond to incident.

Smoke detector meets requirements and is operational. Children’s toys and play equipment are safe and age appropriate. Fireplace is screened. Primary telephone is cell which is operational. Per Licensee, there are no firearms or other weapons in the home. Licensee has all appropriate forms posted. There are no pets at facility. Children’s records were reviewed. Pediatric CPR and First-Aid certificate are valid through October 2019. There are no new adults living or working in the home. All adult residents and helpers have criminal record clearance/ exemptions and child abuse index clearances. Last fire drill was conducted on January 2, 2018. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA also reviewed the following: reporting suspected child abuse & neglect, maintain children’s records according to regulation, post all required forms, ensure that all adults living or working in home have criminal background clearances to avoid civil penalties, emergency drills, heat-related illness, child passenger law, unusual incidents, mandated reporting, SIDS and Shaken Baby Syndrome. Licensee is reminded that corporal punishment, smoking, walkers, exersaucers, jumpers and bouncy seats shall never be permitted during daycare operation. AB 1207 was discussed. Licensee is to complete the Mandated Child Abuse training per AB1207 and submit certificate upon completion. Licensee was unable to provide documentation of immunizations per SB792. An exit interview was conducted. A copy of this report along with LIC809-D and appeal rights (LIC 9058) were left at facility. Licensee’s signature on this form acknowledges receipt of these rights. Per AB633, upon receipt, licensee shall post (observed by LPA) & provide copies of this licensing report to parents/guardians of children in care at the facility & to parents/guardians of newly enrolled at the facility during the next 12 months.
