Ana Chico and Rita Ramos, Licensing Program Analysts (LPAs) conducted an unannounced complaint inspection. LPAs initially met with Nancy Darwich, Administrator. LPAs identified themselves and the purpose of the visit. LPAs were informed that director was at the grocery store.
Upon arrival Director Lena Haiek arrived to the facility. Licensee's husband Louis Haiek arrived approximately 15 minutes. LPAs toured the area, including the adjacent church temple and conducted a second and third head count with the licensee. LPA reviewed the sign in sheets and conducted parent, child and staff interviews.
During the visit, LPA Chico spoke to Regional Manager (RM) Bertha Manzanares. LPA was advised by RM Manzanares that on 11/7/17 Director Haiek and RM had a telephone conversation regarding an previous over capacity citation issued on 10/30/17. RM Manzanares and Licensing Program Manager, Claudia Guangorena specifically discussed Title 22 California Code of Regulations Section 101161(a) Limitations on Capacity and Ambulatory Status at which point Ms. Haiek agreed to stay in compliance. However, on this date, LPAs found that there were 22 children in the Monkeys Room, 15 in the Elephant Room and 27 in the Lion's Room. The total capacity on this date was 64 (license capacity is 60). According to Ms. Haiek she was unaware that she was still over capacity after recently disenrolling 16 children. SEE 9099C *************

Ms. Haiek stated that the children are drop in and, that at least one of those children observed, arrived on a day which was not scheduled. Ms. Haiek acknowledged that based on the current census she should have disenrolled 20 children rather than 16 and/or verified the children's schedules. LPAs reviewed the sign in sheets for the month of November and found that licensee was also over capacity on November 8th and 15th ( Wednesday's).

Based on the information gathered, LPA found there was enough evidence to support the allegation that the licensee has been over capacity. This agency has deemed that the preponderance of the evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 are being cited on the attached LIC9099D.

Exit interview conducted with Director. Appeal Rights were discussed and provided. Notice of Site Visit must be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit must be posted for 30 consecutive days along with the report provided. Failure to maintain posted as required will result in a $100.00 civil penalty. Copies of this report must be provided to the authorized representatives of all currently enrolled children and to newly enrolled children for the next 12 months. The report shall be provided no later than the next business day or the next day the child is in care. ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The Licensee’s signature on this reports acknowledges receipt of her rights.

During this inspection LPA observed 64 preschoolers in the facility. Licensee's capacity is 60.

Director immediately contacted parents of four children. Children were no longer at the facility by the end of this visit.
Director stated that enrollment is low on Tuesday's and Thursday's and will offer parents enrollment on those days. If days offered do work, four children will be terminated. An updated roster will be submitted by POC date.

Director provided a declaration stating that she will turn children away moving forward should she be over her licensed capacity. See attached 421FC for Civil Penalty assessment for second violations within a 12 month period.
