Licensing Program Analyst (LPA) Myriam Saullo Luga conducted a visit to evaluate the facility to ensure operation within the license capacity limit and that the deficiency cited on 1/12/2017 for operation over the license capacity was corrected. LPA met with the facility director Mali Heifetz and licensee, Sapir Adani Razla and explained the purpose of the visit. LPA toured the facility indoor and outdoor. There were 35 children present with 4 staff. The facility is licensed for a maximum capacity of 20 children. The facility was found to continue operating over capacity and the deficiency was not corrected. LPA addressed with licensee that operating above license capacity is a very serious violation of the regulations and the fire clearance, which poses an immediate health and safety hazard/risk for children and that the licensee must adhere to the approved facility license capacity of 20 children. Type A citation is issued accordingly. Since this is the second time the facility is cited for being over the license capacity within 12 month period ( the first citation was issued on 1/12/2017), a civil penalty of 150 dollar was assessed. During the visit, licensee contacted parents to pick up children. The facility shall provide to the parents or guardians of each child receiving services in the facility copies of this report. The facility director shall provide to the parents or legal guardians of the newly enrolling child/children copies of this report for a 12 month period . The facility director will ensure that all parents receive and sign LIC 9224, "Acknowledgment of receipt of Licensing reports". A total of 15 children were picked up between 1:30 PM and 3:30 PM which dropped the census to 20 children- the maximum capacity of the facility license. The deficiency was corrected during the visit. The Department will follow up with the facility for continued compliance to regulations. An Exit interview was conducted and a copy of this report along with the appeal rights were provided to the facility. The facility director will ensure that this report, the civil penalty and the notice of site visit are posted for 30 days.

The facility is licensed for a capacity of 20. LPAs observed 35 children present during the visit.

During the visit, the facility director contacted parents to pick up children and 15 children were picked up. LPAs recounted the number of children after and twenty children were present which is the number of the maximum capacity for the facility license.

101195(d) Penalties-When a child care center is cited for a deficiency and violates the same regulation subsection(101161(a) Limitations on Capacity and Ambulatory Status) within a 12-month period, the child care center shall be cited and an immediate penalty of $150 per cited violation shall be assessed for one day only.
