Licensing Program Analyst (LPA) Trevino Cochran met with licensee, Maureen Rinker, who guided analyst on a tour of the home for a 3 Year Required inspection. Upon arrival LPA Cochran observed 12 children in care being supervised by 4 adults. This is a 1 story, 2 bedroom, 1 bathroom home with kitchen/dining, living room and rear guest house/converted garage.. There is no pool, spa or other bodies of water on the premises. Family members residing in the home include 2 adults.

Main care is provided in the rear guest house/converted garage of the home. LPA observed the main care area to have active play, learning materials, games and activities. LPA observed guest house with a loft. Children use the restroom located in the guest house. Children have access to the main care area, and front/living room of the home. Off limit areas include the home's 2 bedrooms, and kitchen. LPA observed off limit areas with gate making areas inaccessible to children in care. The kitchen and bathroom areas were inspected for proper storage of chemicals, detergents, cleaning compounds, medications and sharp pointed objects. All items were made inaccessible to children. Bathroom/kitchen cabinets observed with latches. Kitchen drawers do not have latches but no sharp items observed. All electrical outlets observed with protective covers. Licensee was reminded the rear guest house/converted garage can be used for activities only, no napping or meals allowed. Facility sign in observed complete and maintained current.

LPA inspected the backyard. LPA observed age appropriate toys, grass/turf and activities for children in care. Per licensee, there are no weapons or firearms of any kind in the facility at this time. The LPA did not observe any weapons. There are age appropriate toys and napping equipment on the premises. Children nap on cots .The required fire extinguisher (2A10BC) and smoke detectors are in operable condition. The home has a Carbon Monoxide detector. Home has central AC and heat. CPR/First Aid expire 02/2018. The First Aid kit was observed and is complete. Licensee has posted as required the License, Emergency Disaster plan and Parents Rights Poster.

AB 1207: Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. Website: www.mandatedreporterca.com

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.

New Immunization Requirement: Law enacted by SB 277, beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

New Appeal Process: A licensee may file an appeal, in writing 15 business days from the date of receiving the penalty assessment.

Nutrition Requirement: Beginning January 1, 2016, AB 290 will require for each new license issued, at least one director or teacher at each child care center or family child care home to have at least one hour of training in the importance of childhood nutrition. This applies to anyone submitting a new application, relocating their facility, selling their facility or transferring their license. Please note this training cannot be completed online or by home study programs. The training must be taken from an Emergency Medical Services Authority (EMSA) approved training program OR an accredited college or university.

The facility was found in compliance per Title 22 regulations, no Type A and B deficiencies will be cited today 10/12/2017.

State law prohibits baby walkers, bouncy seats, exer-saucers and any other items that fall into that category. All infants must be placed on their backs when sleeping to prevent S.I.D.S. (Sudden Infant Death Syndrome), and that the Provider is required to wash hands after every diaper change and to never shake a baby to prevent the Shaken Baby Syndrome. Only children eating may be in high chairs and that car seats are utilized only for transportation.

The licensee was informed of The Child Care Advocate Program (CCAP) that is administered from within the Community Care Licensing Division. CCAP participates in many community activities and special projects in order to disseminate information on the State’s licensing role, provide information to the public and parents on child care licensing, and provide many other helpful resources to the licensees and the public. Update on Incidental Medical Services: Facilities that provide Incidental Medical Services (IMS) must identify those services in their facility’s Plan of Operation and submit an updated Plan of Operation to the Department. Incidental Medical Services Include: Blood-Glucose Monitoring for Diabetic Children, Administering Inhaled Medication, Administering EpiPen Jr. and EpiPen or other Epinephrine Auto-Injectors, Glucagon Administration, Gastrostomy Tube Care (G-tube care), Insulin Injections Administration, Anti-Seizure Administration, and Emptying an Ileostomy Bag.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following was discussed with the licensee:
Mandatory Forms for the children’s files and provider’s files, Requirements for fire drills, earthquake drills and documentation for both. Role and responsibilities of being a mandated reporter were discussed. The licensee was advised how to access forms and Regulations for Family Child Care online at www.ccld.ca.gov . Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. The licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified. Regulation prohibits the smoking of tobacco in a private residence licensed as a family child care home 7 days a week, 24 hours a day. State law prohibits baby walkers, bouncy seats, exer-saucers and any other items that fall into that category.

Requirements for fingerprint clearances and associations were discussed with the licensee. Licensee can be cited a civil penalty of $500 per day, up to $500.00 for the 1st offense and up to $3000.00 for the 2nd offense within a 12 month period. The licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B. The "Notification of Parent's Rights" (2016) poster must be posted in an area of the home accessible to parents. The information regarding new legislation with regards to exemptions and Parent’s Rights was also discussed.

The licensee was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If a serious violation is cited, a copy of the licensing report (LIC809 or LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent when a serious deficiency, Type A, is cited (LIC9224).
